How are my bookings protected?
Holirays is part of the JLT Group that has both an ATOL license (12564) and is a member of PTS (6090).
How Does ATOL Protect Bookings?
ATOL protects bookings through a combination of financial safeguards and regulatory oversight to ensure that consumers are not left out of pocket or stranded abroad if a travel company* ceases trading. Here’s a detailed breakdown of how ATOL protection works:
*Travel Company means either The JLT Group and agents operating under the JLT Group OR third party ATOL holders (like, Jet2, Easyjet, TUI or other tour operators)
Financial Protection
Refunds: If a travel company with an ATOL licence goes out of business before the customer’s trip begins, ATOL guarantees a full refund for the booked holiday. This applies to package holidays and flights that include at least one flight arranged by an ATOL-holding travel company.
Repatriation: If the travel company ceases trading while customers are abroad, ATOL ensures that they are brought back to the UK at no additional cost. The scheme covers the cost of flights and other necessary arrangements to ensure safe return.
ATOL Certificate
Proof of Protection: When a customer books an ATOL-protected holiday, they receive an ATOL Certificate. This certificate serves as proof that their booking is protected under the ATOL scheme. The certificate details what is protected and provides essential information on how to use the protection in case of travel company failure.
CAA Oversight
Licensing Requirements: The Civil Aviation Authority (CAA) rigorously assesses and monitors travel companies to ensure they meet the financial and operational standards required for an ATOL licence. Companies must demonstrate financial stability and provide guarantees or bonds to cover potential claims.
Consumer Information
Awareness and Guidance: ATOL-licensed travel companies must provide clear information to consumers about the protection they receive. In case of a travel company failure, the CAA and the ATOL scheme offer guidance on how to claim refunds or arrange repatriation.
Package Holidays and Flight-Plus Arrangements
Package Holidays: The majority of package holidays sold in the UK are covered by ATOL, providing comprehensive protection for consumers who book multiple travel services (e.g., flights, accommodation) as part of a package.
Flight-Plus: ATOL also protects Flight-Plus arrangements, where consumers book a flight and additional travel services (like accommodation or car hire) within a day of each other, creating a linked travel arrangement.
Before Travel: If a travel company goes out of business before the trip starts, ATOL ensures customers receive a full refund for their bookings.
During Travel: If a company fails while customers are abroad, ATOL covers the cost of bringing them back to the UK, ensuring they are not stranded.
Consumer Assurance: The ATOL Certificate serves as an official document confirming the protection and details the steps to take in case of travel company failure.
How does PTS protect my booking?
Protected Trust Services (PTS) offers a comprehensive approach to ensure consumer protection, primarily through its trust account model and additional insurance mechanisms.
Supplier Failure Insurance: PTS provides Supplier Failure Insurance which covers consumers in case a key supplier involved in the travel package, like a hotel or an airline, goes out of business before the service is rendered. This insurance ensures that consumers either receive a refund or a suitable alternative arrangement so their travel plans can proceed smoothly.
Travel Disruption Insurance: In addition to Supplier Failure Insurance, PTS can offer access to Travel Disruption Insurance, which covers additional costs that may arise due to unexpected changes in travel plans, such as cancellations, delays, or interruptions. This type of insurance is particularly beneficial in situations where external factors, such as weather or strikes, impact the travel arrangements.
Comprehensive Liability Insurance: PTS ensures that its members have appropriate levels of liability insurance, which protects against claims made by clients for issues like injury or loss that occur during travel. This type of insurance is crucial for safeguarding both consumers and businesses in the face of unforeseen incidents.
Compliance with Package Travel Regulations: Although not an insurance product, PTS’s strict compliance with Package Travel Regulations acts as a protective measure, ensuring that all travel packages offered by its members provide adequate consumer rights and protections as mandated by law. This includes proper information disclosure, a high standard of service, and additional protections in cases of company failures.
By integrating these insurance options with their trust account model, PTS provides a robust protection framework that not only secures consumer funds but also addresses potential disruptions and liabilities, thereby offering a comprehensive safety net for travellers.
PTS provides a more comprehensive cover for consumers than ABTA, particularly because of its robust combination of financial protection through trust accounts, multiple additional insurances, and comprehensive legal compliance support. This makes PTS a preferable option for consumers seeking broad protection that extends beyond just package holidays to include a wide range of travel services and potential issues. ABTA, while highly respected and beneficial, particularly for package holiday protection and dispute resolution, offers a narrower scope of direct consumer protections compared to PTS.
